Johnson and Hudecki argue that Bernard Suits fails to refute Wittgenstein’s ‘family resemblance’ view of games because Suits’s account of how games begin, how they are played, and the ends they involve, fails to match basic facts of player experience. In reply, the current paper describes three keys to interpreting The Grasshopper: (1) distinguishing the four perspectives from which Suits describes games, (2) recognizing Suits' dispositional view of rule following, and (3) understanding the geometrical metaphor Suits uses to describe rules. Bernard Suits is commonly thought to have defined games as challenges. This paper argues that Suits could not have done so without ruining his larger philosophical project. It then argues that he did not do so. Suits defined game playing in quantitative terms (i.e. being more or less efficient) not qualitative ones (e.g. difficulty, struggle). The paper concludes by exploring the consequences of this shift in perspective.

Plato’s Euthyphro presents a puzzle about priority: is deity prior to morality, or vice versa? A Neoplatonic solution identifies God with the Good, claiming the dilemma to be illusory. If we treat the orders of being and power as distinct, however, the God of Genesis 1 may seem to be prior in one order, while goodness is prior in the other; the picture becomes complex, with the various senses of priority apparently balancing out. Without being either Neoplatonic or following other (...) ancient theologies, therefore, Genesis 1 challenges Plato’s dichotomy, highlighting the potential for finding philosophical resources in theological texts. While Bernard Suits's understanding of games has significantly influenced the philosophy of sport, the longest sustained investigation in The Grasshopper is of make-believe and roleplaying games. Suits’s discussion of make-believe and roleplaying is found in chapters 9 through 12, but what he says there is uncharacteristically unclear. To clarify Suits’s account, the present paper distinguishes between two arguments that Suits interweaves. In the first, Suits argues that game playing is not a species of play. In the second, Suits argues that (...) playing a make-believe or role-playing game is the same — at heart — as playing a game of any type. While the paper takes no position on the former, it defends the latter argument against several important objections by Thomas Hurka and C. Thi Nguyen. It contends, furthermore, that Suits is not simply trying to show that his theory of game playing can account for make-believe and roleplaying games. Rather, Suits is also using make-believe and roleplaying games to clarify exactly how his theory of game playing should be understood. (shrink)

This article argues that philosophers tend to employ a particular method in constructing their theories and critiquing their opponents. To substantiate this claim, the article examines the work of Nietzsche and Locke, the Empiricists and Rationalists, Heidegger, Levinas, and Derrida, and Russell and Wittgenstein, showing how each relies on a method the article labels “revolution-through-return.” The method consists in identifying the authority behind your opponent's theory, then appealing to something “prior to” that authority, from which you then proceed to derive (...) your own theory. The article distinguishes between several senses of priority, argues that modern philosophers tend to rely on temporal priority, and discusses the questions in priority theory that need to be addressed in order evaluate and construct revolution-through-return arguments. While tens of thousands of people across the United States serve on hospital and other healthcare ethics committees, almost no carefully prepared educational material exists for HEC members. Ethics by Committee is a one volume collection of chapters developed exclusively for this educational purpose. Experts in bioethics, clinical consultation, health law, and social psychology from across the country contribute chapters on ethics consultation, education, and policy development.

In this article, we analyze the intractability of the low-level radioactive waste debate in California through the construction and examination of policy frames and their associated policy narratives. Relying primarily on reports, formal comments, and written correspondence, we reconstruct three policy frames and explore their interaction in the public debate through the policy stories told by the actors. We analyze how policy actors using these policy frames appropriate available information, value scientific input, and respond to uncertainty in technical and regulatory (...) information to create policy stories. These policy frames and their associated policy narratives demonstrate how policy actors differ in their drivers for action, bases for trusting claims, and response to uncertainty. These differences lead to divergent characterizations of the risk of low-level radio-active waste disposal. This analysis provides insight into the dynamics of intractable policy controversies. Starting from the insights of classical American pragmatism, this book argues for a higher notion of the relationship between individuals and their communities. This newly enriched notion supports a more participatory engagement between physicians and patients which takes ethical medicine to be a community of healing enjoyed by health care professionals and those they care for.

Background If trials of therapeutic interventions are to serve society's interests, they must be of high methodological quality and must satisfy moral commitments to human subjects. The authors set out to develop a clinical - trials compendium in which standards for the ethical treatment of human subjects are integrated with standards for research methods. Methods The authors rank-ordered the world's nations and chose the 31 with >700 active trials as of 24 July 2008. Governmental and other authoritative entities of the (...) 31 countries were searched, and 1004 English-language documents containing ethical and/or methodological standards for clinical trials were identified. The authors extracted standards from 144 of those: 50 designated as ‘core’, 39 addressing trials of invasive procedures and a 5% sample of the remainder. As the integrating framework for the standards we developed a coherent taxonomy encompassing all elements of a trial's stages. Findings Review of the 144 documents yielded nearly 15 000 discrete standards. After duplicates were removed, 5903 substantive standards remained, distributed in the taxonomy as follows: initiation, 1401 standards, 8 divisions; design, 1869 standards, 16 divisions; conduct, 1473 standards, 8 divisions; analysing and reporting results, 997 standards, four divisions; and post-trial standards, 168 standards, 5 divisions. Conclusions The overwhelming number of source documents and standards uncovered in this study was not anticipated beforehand and confirms the extraordinary complexity of the clinical trials enterprise. This taxonomy of multinational ethical and methodological standards may help trialists and overseers improve the quality of clinical trials, particularly given the globalisation of clinical research. Aristotle’s influence on D’Arcy Thompson was praised by Thompson himself and has been recognized by others in various respects, including the aesthetic and normative dimensions of biology, and the multicausal explanation of living forms. This article focuses on the relatedness of organic forms, one of the core problems addressed by both Aristotle’s History of Animals (HA), and the renowned chapter of Thompson’s On Growth and Form (G&F), “On the Theory of Transformations, or the Comparison of Related Forms.” We contend (...) that, far from being an incidental inspiration stemming from Thompson’s classicist background, his translation of HA played a pivotal role in developing his theory of transformations. Furthermore, we argue that Thompson’s interpretation of the Aristotelian method of comparison challenges the prevailing view of Aristotle as the founder of “typological essentialism,” and is a key episode in the revision of this narrative. Thompson understood that the method Aristotle used in HA to compare animal forms is better comprehended as a “method of transformations,” leading to a morphological arrangement of animal diversity, as opposed to a taxonomical classification. Finally, we examine how this approach to the relatedness of forms lay the foundation for a causal understanding of parts and their interconnections. Although Aristotle and Thompson emphasized distinct types of causes, we contend that they both differ in a fundamental sense from the one introduced by Darwin’s theory of natural selection, which was formulated as a solution to the species problem rather than the form problem. We conclude that Thompson’s interpretation of Aristotle’s approach to form comparison has not only impacted contemporary scholarship on Aristotle’s biology, but revitalized a perspective that has regained significance due to the resurgence of the problem of form in evo-devo. This article examines the philosophical work of Dallas Willard, Emeritus Professor of Philosophy at the University of Southern California. After outlining his major translations, it explores four of Willard’s central theses: that Husserl’s phenomenology of knowledge solved a fundamental puzzle about the objectivity of knowledge; that the success of Husserlian phenomenology’s account of knowledge depended upon Husserl’s ontological insights; that Husserl was already a phenomenologist when Frege was purportedly converting him from psychologism; and that Husserl maintained his early account of (...) knowledge—and thus his realism—throughout his career. Though Willard was instrumental in starting the “Early” or “Realist Phenomenology” movement in America, his philosophical contributions have yet to be fully explored. There is a critical inconsistency in the literature on analogical retrieval. On the one hand, a vast set of laboratory studies has found that people often fail to retrieve past experiences that share deep relational commonalities, even when they would be useful for reasoning about a current problem. On the other hand, historical studies and naturalistic research show clear evidence of remindings based on deep relational commonalities. Here, we examine a possible explanation for this inconsistency—namely, that remindings based on relational (...) principles increase as a function of expertise. To test this claim, we devised a simple analogy‐generation task that can be administered across a wide range of expertise. We presented common events as the bases from which to generate analogies. Although the events themselves were unrelated to geoscience, we found that when the event was explainable in terms of a causal principle that is prominent in geoscience, expert geoscientists were likely to spontaneously produce analogies from geoscience that relied on the same principle. Further, for these examples, prompts to produce causal analogies increased their frequency among nonscientists and scientists from another domain, but not among expert geoscientists (whose spontaneous causal retrieval levels were already high). In contrast, when the example was best explained by a principle outside of geoscience, all groups required prompting to produce substantial numbers of analogies based on causal principles. Overall, this pattern suggests that the spontaneous use of causal principles is characteristic of experts. We suggest that expert scientists adopt habitual patterns of encoding according to the key relational principles in their domain, and that this contributes to their propensity to spontaneously retrieve relational matches. We discuss implications for the nature of expertise and for science instruction and assessment. (shrink)

Throop (bio)In discussions about the future of environmental philosophy, I have found myself supporting two positions that are in tension with one another. The first, which has been well explored in the last decade, is that environmental philosophy should have a more dramatic impact outside of academic circles. It should affect policy and guide the behavior of non-philosophers, which (...) usually requires that it deeply engage the empirical details of problems it addresses. The second is that environmental philosophy needs to improve its status within the larger philosophical community, which requires its practitioners to use methods that dominate mainstream philosophy and to be conversant with contemporary work in ethical theory, epistemology, metaphysics, and continental philosophy. Some have argued that this tension places a double burden on those training to be environmental philosophers; they must demonstrate both theoretical and practical excellence. I fear that such a standard will limit [End Page 147] the growth of environmental philosophy. It will be daunting to new environmental philosophers and achieved by only a few.With respect to this tension, I suggest that environmental philosophy should support a robust division of labor. Many new environmental philosophers should be recruited from cohorts trained primarily in core areas of philosophy. Most of these thinkers will probably focus on highly theoretical issues—issues that anyone in the field would recognize as philosophical.Their knowledge of environmental problems may be superficial and their audience likely will consist primarily of other philosophers. Their impact beyond philosophy may be quite limited (except for their students). I come from this tradition, and I am still delighted by the purely intellectual puzzles that our field generates. Work of this sort should be honored, but our field will be sterile if it is dominated by this kind of thought.I hope that many other new environmental philosophers will be trained in interdisciplinary environmental graduate programs or "applied" philosophy Ph.D. programs where they will acquire the interdisciplinary expertise necessary to address practical problems and to effectively engage non-philosophical audiences. This group of "practical" environmental philosophers should also include a host of practitioners in other fields who contribute to philosophical dialogue. I suspect that much work in this area will be case-based, empirically sophisticated and, where it addresses non-philosophical audiences, more reliant on compelling metaphors than on tight arguments. I doubt that it is fruitful to view this group as applying the work of the former group. The aims, the sources of insight and the standards of quality for the two groups are categorically different. For practical philosophers, the political feasibility of a proposal matters, and the arguments must have the capacity to move relevant stakeholders. The results of this work may appear to be philosophy-lite to those in the first group, but only if judged by standards that are inappropriate if we accept a division of labor in the field.This division of labor cannot be an apartheid. Many promising innovations in environmental philosophy will come from the interface between these groups. And unfortunately, a good bit of questionable work done in each group may result from a failure to understand progress that has been made by the other group. For example, philosophers focused only on theory may draw implications for action that fail to accord with current empirical information. Practical philosophers may [End Page 148] critique simplified metaethical positions that have long been abandoned in favor of more sophisticated versions. A healthy dialogue and a mutual respect should diminish these dangers. Such a division of labor has significant implications for graduate education, hiring and evaluation of faculty, and allocation of prestige within the field. Organ procurement presents several ethical concerns (from what constitutes acceptable criteria for death to issues involved in specifically designating to whom an organ can be given), but none is more central than the concern for what are appropriate means for acquiring organs. The following discussion attempts a different perspective on the issue of organ procurement by arguing that, rather than appealing to our charitable consciences or our pocketbooks, relinquishing our organs after death in this day and age is, in fact, (...) obligatory for most people. Each of us is pressed by the growing demand for our organs should we die ?rightly,? and that desperate need has risen to such a level that not to release our organs for transplantation would constitute a serious moral wrong. Disease and injury creates a break between the individual and the community which compromises the individual's status within the community as well as the integrity of the self as a “product” of social interaction. Our “everyday” activities are called into question since our ability to fulfill obligations and to achieve many of our ends is diminished through the weakening of our bodies. In light of this account of disease, healing is about restoring the individual to a state of vital functioning, (...) and vital functioning entails communal participation. As John Dewey points out, health as “living healthily” can be understood only in context of each patient's pursuits which are always social and communal. But, if living in community with others is the end-in-view for medical encounters, it too must be implicated in the means to that end. A patient who is given the opportunity to participate as a member of the health care community has already begun within the medical encounter itself to live healthily. It follows, then, that we must work to promote new attitudes within health care towards aiding in the effective agency and participation of patients in their healing process – i.e., we must see community as healing. In response to Anne L. Dalle Ave and David M. Shaw, we agree with their general argument but emphasize a moral risk of HIV disclosure in deceased donation cases: the risk of relational rupture. Because of the importance that close relationships have to our sense of self and our life plans, this kind of rupture can have long-ranging implications for surviving loved ones. Moreover, the now-deceased individual cannot participate in any relational mending. Since the decade of the 1970s, and particularly since the first successful test-tube baby in 1978, the development and use of assisted reproductive technologies have grown exponentially. Would-be parents—including those in so-called traditional male-female marriages, unmarried adults, postmenopausal women, and same-sex partnerships—who just over 20 years ago had no recourse for their fertility issues can now pursue their desires to have children with at least a partial, if not, total, genetic and/or biological relationship. Ovulation-stimulating medications, artificial insemination using the sperm (...) of a husband or unrelated donor, in vitro fertilization with embryo transfer, intracytoplasmic sperm injection, and gamete and zygote intrafallopian transfers are but a few of a host of treatment options ranging in complexity, invasiveness, and expense. And on the horizon are genetic techniques such as cloning—which was once considered “pure” science fiction but in 1997 became what some call an inevitability, with the development of mammalian cloning in the form of the now-famous Dolly the sheep. In April of 2001 I published a brief commentary in the journal Academic Medicine questioning the current character and functioning of the National Residency Matching Program. The purpose of the article was to stimulate a rethinking of process. At 50 years old, the environment through which the match operates has changed, and as such I thought it time to ask ourselves whether or not the match, its algorithm, and, more important, the values it manifests might well need an overhaul.

The term community in ethics and bioethics traditionally has been used to designate either a specific kind of moral relationship available to rational agents or, in contrast, the context in which any sense of rational agency can even be understood. I argue that bioethics is better served when both selves and community are expressed through a more processive language that highlights the functional character of such concepts. In particular, I see the turn to processive community in bioethics as a turn (...) towards method, contextualization, and narrative. In clinical practice, such a processive account demands that bioethics concentrate on methods of developing healthy dialogue and deeper understanding from within the problematic situation rather than trying to fix problems using ethical tools developed from outside the present situation. Community, I argue, is in and of the interactive processes of inquiry itself. Such inquiry, such communitying, requires that we engage individual patients in context; it demands more than simply gaining their permission or mere consent; it demands developing a supportive environment for participation. Several months ago, I was walking down the hallway outside our medical school faculty offices and a colleague stopped me to ask a question. He phrased his query in the context of a case that raised ethical issues for him, and he asked me to respond. I obligingly offered my opinion given the details he presented, ending my comments with the phrase, To this he kindly shot back, To be honest, this question caught me off guard. Though his particular dilemma (...) was relatively well-trod territory for many bioethicists, I had done little research on the issue and could not immediately render a response to his latter query.
